Also, you grant such other specified users a license to access that Limited Audience User Submission, and to use and exercise all rights in it, as permitted by the functionality of the Services.

• You agree that the licenses you grant are royalty-free, perpetual, sublicensable, irrevocable, and worldwide, provided that when you delete your 10X Futures Network LLC account, we will stop displaying your User Submissions other than Public User Submissions, which may remain fully available to other users, but you understand and agree that it may not be possible to completely delete that content from 10X Futures Network LLC records, and that your User Submissions may remain viewable elsewhere to the extent that they were copied or stored by other users.
• Finally, you understand and agree that 10X Futures Network LLC, in performing the required technical steps to provide the Services to our users, may need to make changes to your User Submissions to conform and adapt those User Submissions to the technical requirements of connection networks, devices, services, or media, and the foregoing licenses include the rights to do so.
• Any information or content publicly posted or privately transmitted through the Services is the sole responsibility of the person from whom such content originated, and you access all such information and content at your own risk, and we aren’t liable for any errors or omissions in that information or content or for any damages or loss you might suffer in connection with it. • 10X Futures Network LLC products and products associated with 10X Futures Network LLC are the only products within 10X Futures Network LLC that currently carry a fee, and we reserve the right to additionally charge for any future and additional services. We will notify you as additional Services are added, and if you wish to continue using such Services, you must pay all applicable fees for such Services.
• You’re free to do that at any time, by cancelling your subscription. You can also contact us at support@10XFuturesNetwork.com anytime with questions; please refer to our Privacy Policy as well and the licenses above, to understand how we treat information you provide to us after you have stopped using our Services. 10X Futures Network LLC is also free to terminate (or suspend access to) your use of the Services or your account, for any reason in our discretion, including your breach of these Terms. 10X Futures Network LLC has the sole right to decide whether you are in violation of any of the restrictions set forth in these Terms.
• Account termination may result in destruction of any Content associated with your account, so keep that in mind before you decide to terminate your account. We will try to provide advance notice to you prior to our terminating your account so that you are able to retrieve any important User Submissions you may have stored in your account (to the extent allowed by law and these Terms), but we may not do so if we determine it would be impractical, illegal, not in the interest of someone’s safety or security, or otherwise harmful to the rights or property of 10X Futures Network LLC.
• Provisions that, by their nature, should survive termination of these Terms shall survive termination. By way of example, all the following will survive termination: any obligation you have to pay us or indemnify us, any limitations on our liability, any terms regarding ownership or intellectual property rights, and terms regarding disputes between us.
• Neither 10X Futures Network LLC nor its licensors or suppliers makes any representations or warranties concerning any content contained in or accessed through the Services, and we will not be responsible or liable for the accuracy, copyright compliance, legality, or decency of material contained in or accessed through the Services. We (and our licensors and suppliers) make no representations or warranties regarding suggestions or recommendations of services or products offered or purchased through the Services. Products and services purchased or offered through the Services are provided and without any warranty of any kind from 10X Futures Network LLC or others (unless, with respect to such others only, provided expressly and unambiguously in writing by a designated third party for a specific product). TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) SHALL 10X Futures Network LLC (OR ITS LICENSORS OR SUPPLIERS) BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, OR (B) ANY AMOUNT, IN THE AGGREGATE, IN EXCESS OF THE GREATER OF (I) $100 OR (II) THE AMOUNTS PAID BY YOU TO 10X Futures Network LLC IN CONNECTION WITH THE SERVICES IN THE TWELVE (12) MONTH PERIOD PRECEDING THIS APPLICABLE CLAIM, OR (III) ANY MATTER BEYOND OUR REASONABLE CONTROL. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY TO YOU.
• Indemnity. You agree to indemnify and hold 10X Futures Network LLC, its affiliates, officers, agents, employees, and partners harmless from and against any and all claims, liabilities, damages (actual and consequential, losses and expenses (including attorneys’ fees arising from or in any way related to any third party claims relating to (a) your use of the Services (including any actions taken by a third party using your account), and (b) your violation of these Terms. In the event of such a claim, suit, or action (“Claim”), we will attempt to provide notice of the Claim to the contact information we have for your account. If failure to deliver such notice shall not eliminate or reduce your indemnification obligations hereunder.
• Arbitration. These Terms are governed by and will be construed under the laws of the State of Florida, United States, without regard to the conflicts of law’s provisions thereof. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled in Pinellas County, Florida, United States. Judgment upon the award rendered by such arbitrator may be entered in any court of competent jurisdiction. Notwithstanding the foregoing obligation to arbitrate disputes, each party shall have the right to pursue injunctive or other equitable relief at any time, from any court of competent jurisdiction. For all purposes of this Agreement, the parties’ consent to exclusive jurisdiction and venue in the state or federal courts located in, respectively, Pinellas County, Florida, United States, or the within the state of Florida. Any arbitration under this Agreement will take place on an individual basis: class arbitrations and class actions are not permitted. You understand and agree that by entering into this agreement, you and 10X Futures Network LLC are each waiving the right to trial by jury or to participate in a class action.
• You will be responsible for paying, withholding, filing, and reporting all taxes, duties, and other governmental assessments associated with your activity in connection with the Services, provided that 10X Futures Network LLC may, in its sole discretion, do any of the foregoing on your behalf or for itself as it sees fit. The failure of either you or us to exercise, in any way, any right herein shall not be deemed a waiver of any further rights hereunder. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated, to the minimum extent necessary, so that these Terms shall otherwise remain in full force and effect and enforceable. You and 10X Futures Network LLC agree that these Terms are the complete and exclusive statement of the mutual understanding between you and 10X Futures Network LLC, and that it supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of these Terms. You hereby acknowledge and agree that you are not an employee, agent, partner, or joint venture of 10X Futures Network LLC, and you do not have any authority of any kind to bind 10X Futures Network LLC in any respect whatsoever. You and 10X Futures Network LLC agree there are no third-party beneficiaries intended under these Terms.
• 10X Futures Network LLC offers Performance Based Trading, Contests, and Competitions: Simulated Trading Opportunities with performance-based contests or competitions run by 10X Futures Network LLC 's discretion. 10X Futures Network LLC contests and competitions are for Educational Purposes only. Void Where Prohibited. Not all features, contests, competitions, products or services discussed, referenced, provided or offered through or in connection with the 10X Futures Network LLC are available to all persons or in all geographic locations. 10X Futures Network LLC reserves the right to limit, in its sole discretion, the provision and quantity of any feature, contest, competition, product or service to any person or geographic area. Some of the functions, features or other content mentioned on the website may not be available to all persons or in all geographic locations or jurisdictions. Furthermore, 10X Futures Network LLC makes no claims that the website or any of its content is appropriate outside of the United States. Access to the website or participation in any contest or competition may not be legal by certain persons or in certain countries, and such access is prohibited. • Trader vs Trader Contests From time to time, 10X Futures Network LLC may, in its own discretion, have a contest or sweepstakes whereby Traders may compete to win a cash prize based on accumulating the most 10X Futures Network LLC Synthetic Currency during a period of time set at 10X Futures Network LLC ‘s discretion. Trader agrees to these terms and conditions and will not hold 10X Futures Network LLC liable for any errors in such contests or sweepstakes.
• Contest Statistics I hereby acknowledge and agree that by using 10X Futures Network LLC services my 10X Futures Network LLC ID and stats may be used and displayed on the 10X Futures Network LLC leaderboard and including, but not limited to any other pages of the 10X Futures Network LLC website and application.
   
• Refund Policy
• Please check the rates/subscription fees as there are no refunds once a trader has signed up and paid for a subscription.
• In certain circumstances, requests for a refund may be accepted within 48 hours of the full subscription purchase. If we offer a refund of the subscription purchase within 48 hours of purchase, each request must be accompanied by a detailed and grounded reason why you apply for a refund.
• If a refund is issued, we subtract 20% of the charged amount to cover the merchant services charges and fees.
• Again, please be advised that all sales are final. No returns, refunds, or exchanges, partial or otherwise, for any reason. Once your order has been placed and your credit card billed or processed, there are no returns or credit. You may not return the product and demand a refund, as you were supplied intellectual property as well.
• All our products are distributed and licensed on an ‘as is’ basis and there are no warranties, guarantees, or promises of any kind by 10X Futures Network LLC as to their performance, reliability or suitability to any given task. Auto Renewals

All subscriptions will renew automatically for that product’s specified renewal rate. An evaluation renewal does not change any account balance or reset an account once processed.

Subscription Cancellations

You can unsubscribe your Evaluation Account at any moment. Your account will be active until your new billing date.

The account will start and billing commences the day user signs up, continuing every 30 days thereafter until manually cancelled.

You must manage your own subscription(s). If you desire to cancel your subscription it MUST be done via the 10X website and before the renewal date.

You can do this through your 10X Profile. Review your active subscriptions area. Select the needed account and click on the button “Cancel” to cancel your subscription.

Once a subscription is canceled it cannot be renewed.
 

Evaluation Resets

Evaluation resets do not extend the amount of time on your evaluation.

Refunds

All sales of evaluations, data fees, reset fees and other fees associated with evaluation or Funded trading accounts are NON-REFUNDABLE. There are no exceptions.
